The “Landowner Liability Recreational Use Warning Signs” law, signed by Gov. Jared Polis on March 15, shields personal landowners from claims if they publish alerting indications at gain access to indicate their land informing the general public about the specific threats positioned by the land.
The step was proposed following the decision in an accident lawsuit in which the U.S. Air Force Academy was held responsible for not alerting the public about concerns with a bike trail and a bicyclist crashed into a sinkhole. The court granted the cyclist $7.3 million for his injuries.
Although the Colorado Recreational Usage Statute offered some securities, lawmakers say the outcome of the 2017 decision resulted in many privately owned outdoor recreation sites, consisting of websites of famous 14,000-foot peaks, closing out of fear of lawsuits.
In a declaration last month, Colorado Rep. Brianna Titone, a Democrat from Arvada, described that the procedure “makes it easier for Colorado landowners to open their land to those excited to explore the great outdoors and perhaps bag a 14er along the way.”
