After surfacing, the guy shouts out, “I touched it!” and asks his mates, “Did you get it?” Observers yell, laugh, and curse throughout the interaction, which likewise includes the guy swimming towards the whale– a second effort to touch it.

Hayden Loper, DOC principal investigation officer, says the male showed “negligent disregard for his own safety– which of the adult male whale with a calf swimming near the vessel.”

Though the video is from February, DOC states a member of the general public tipped the department off to the disturbing video. “The video left us really stunned,” Hayden stated in the press release. “This is silly behaviour and demonstrates a shocking neglect for the welfare of the orca. It is incredibly careless.”

It’s Illegal to Disturb or Harass Orcas

“Whale are tremendously effective animals, and this truly might have ended terribly– with either the startled whale being injured, or the male responsible being damaged by the exacerbated animal,” DOC states.

The DOC further calls this occurrence “an extremely clear breach of the Marine Mammals Security Act.” Under this legislation, it’s illegal to disturb or bug marine mammals like orcas and other dolphins and whales.

Orcas are the biggest member of the dolphin family, and they’re apex predators in the world’s oceans. It’s really unwise to do anything that an orca might view as a threat. (And yes, that does consist of body slamming.)
